DISCUS and Wine Institute Are in Court Today Over a Packaging Law That Could Set the Template for Every US State.

The Distilled Spirits Council of the United States (DISCUS) and Wine Institute filed an amicus brief on 14 July 2026 in the National Association of Wholesaler Distributors v. Feldon case, the trial for which begins today in the US District Court of Oregon. The brief challenges Oregon’s Extended Producer Responsibility law on the grounds that it disproportionately penalises glass packaging – the primary format for wine and spirits – and violates the Commerce Clause of the US Constitution by imposing costs on producers that they cannot absorb on a state-specific basis.
